This Australian Shepherd is hereafter referred to as the dog.
The purchaser agrees to the following.
1. Provide good quality food, fresh water, adequate shelter and regular grooming fitting a family companion.
2. This dog shall not be maintained as a yard dog, personal protection, and guard or attack animal. This dog shall not ride in the
back of open pickup trucks; preferred method of transport is inside a car or truck, either secured in a crate or a seat belt.
3. To attend AT LEAST ONE FULL CLASS of structured obedience lessons and or Agility classes. The purchasers understands
that Australian Shepherds are naturally reserved with strangers, have strong herding and guarding instincts and are high
energy/high drive breed. It is understood that Australian Shepherds MUST have continued training and socialization throughout
the life of the dog.
4. This dog will receive regular annual veterinary exams. Vaccinations performed by and at the recommended interval the set by
the purchasers’ veterinarian.
5. Notify the breeder if any health or temperament problems develop in said dog.
6. If the purchaser is unable to keep said dog for ANY reason the breeder is to be notified first. The breeder reserves the right of
first refusal to take the dog back. There are NO REFUNDS except what is covered under the warranties section of this contract.
The breeder reserves the right to offer a partial or full refund or replacement dog as they see fit. The breeder is not responsible
for or any monetary cost involved in this dogs return. Upon return the breeder will become sole owner and receive the dog’s
current medical history, registration papers and microchip information sighed back to the breeder. If the purchaser has a home
interested in said dog, the breeder will consider this home on the purchaser recommendation and determine its fitness for this
dog and be involved in its placement.
7.To abide by the ASCA and USASA Breeder code of ethics
8.To show the dog in performance, conformation or herding events to attain titles. Costs involved are the sole responsibility of the
purchaser.
9. To sell all offspring or stud services only on written contract.
IT is of primary concern that all dogs sold by the breeder will be placed in suitable loving homes for an Australian shepherd. An
attempt has been made that no dogs sold by the breeder will end up in puppy mills, Shelters, rescue or be used as breeding
stock for commercial gain. Any dog disposed of without the breeders consent- either surrendered, placed or sold to any of the
above mentioned locations, the purchaser will be held responsible for the original purchase price of said dog and for all costs
involved in its recovery, placement, veterinary expenses and ALL legal expenses incurred by the Breeder.
Health information
1. This dog is in good Physical and mental health at the time of sale. The breeder has disclosed any health problems to the
purchaser. The purchaser must have said dog examined by a veterinarian within 72 hours of sale.
2. This dog has received the first set of booster vaccinations, Worming, Microchip, both a monthly Flea and heartworm
preventative. This dog has had a preliminary Eye Examination by an ACVO certified veterinarian, been checked for heart
murmurs by auscultation, a physical exam by a veterinarian and found visually free of diseases at the time of exam. The
purchaser has been provided with a health certificate and all paperwork on these exams.
3. The purchaser has been provided with a (PREPAID) DNA Blood Kit and information on the ASCA DNA gene bank. It is required
that the purchaser have a blood sample drawn when the dog is old enough to submit a sample that blood sample must be
submitted for DNA parentage verification and also submitted into the ASCA DNA Gene Bank to be available for future studies.
All puppies should receive 3 sets of boosters between 8-16 weeks of age spaced 3-4 weeks apart. Also the puppy should receive
a rabies booster after 12 weeks and a kennel cough vaccination for puppy classes.
The breeder reserves the right to receive at least one stud service free from any male they sell. The service to be
used by the breeder on a bitch either owned, Co-owned or leased by the breeder.
The breeder reserves the right to purchase a puppy from any breeding of any females bred by them. This puppy will
be available buy mutual agreement of both parties as- free, in return for a stud service, at the cost no greater than
what purchaser paid for the Bitch, or as part of a split litter co-breeding agreement
All show quality dogs are sold on a Co-ownership registration. Co-ownership will only be lifted when the purchaser fulfills the
following requirements.
-Hips certified Free of Hip dysplasia- Either by OFA or Penn Hip. OFA Certification-said dog must be issued a Number by the OFA
and given a grading free of hip dysplasia. Penn Hip evaluation- Said dog must have a distraction numbers for either hip joint no
greater than .5 and must be scored to the left of percentile median.
-Elbows Certified by OFA free of Abnormalities
-DNA parentage verification performed by the ASCA DNA lab and sample submitted into the ASCA the Gene bank
-OFA Thyroid profile normal
-Clear Eye exams by an ACVO certified Veterinarian after 2yrs of age.
-Has attained the at least one title or combination of titles of CH (ASCA or AKC) CDX or one of the Stock dog titles available
though ASCA or AKC
Health issues
Like all purebred dogs they can be affected or carriers of several genetic disorders. An information sheet has been provided of
the common problems in Australian shepherds for reference for the new owner. All purebred dog breeders must work within a
limited gene pool. Our Aussies all Share common ancestors.
The breeder cannot/will not “Guarantee” that any dog bred or sold by them will not be affected or carriers of these problems.
Many of these problems are Polygenic (involve many genes) and how they are inherited is not known. The breeder has made
every attempt to reduce or eliminate such problems by using only unaffected dogs, screening test when available and pedigree
research. We feel it is very important for all breeders to work together for the welfare of the breed. The breeder however will
provide compensation to the purchaser as listed in the warranties’s section of this contract.
It is understood that the breeder MUST be notified if said dog is affected by health issues. The breeder ALSO EXPECTS to be
notified if said dog produces affected offspring. The breeder will be contacting ALL purchasers (both pet and show) regularly
throughout the life of the dog to keep updated on the dogs’ health, progress and well-being.
Warranties
We this dog is healthy when it leaves our care. You have 48 hours to have your dog examined by a veterinarian. If He/She is
found to have a health problem or major defect not disclosed at time of sale you must contact the breeder immediately. Upon
verification, you may return the dog for a complete refund of the purchase price.
The breeder IS NOT/WILL NOT responsible for any veterinary expenses, airfare or shipping expenses incurred AFTER purchase.
NO DOG IS TO BE USED FOR BREEDING BEFORE 2 YEARS OF AGE.
-Show quality dogs are free of disqualifying faults at time of sale. They are sold as a good show/breeding PROSPECTS only. The
breeder cannot guarantee success in the show or performance ring. The breeder is not responsible for the unpredictable factors
of grooming, conditioning, training, judges’ opinion and changes in the dog during growth and development.
Once this dog is used for breeding or Stud service, the purchaser has attested that the dog is of breeding quality and assumes
the risk and responsibilities involved with breeding this dog. The breeder is no longer responsible for Replacement or refund
should health, temperament or disqualifying faults develop.
Should this dog develops the below conditions before being used for breeding,
-Develops Hip dysplasia before 30 months of age. Must be verified by OFA evaluation
-Develops Cataracts before 30 months of age- Confirmed by a board certified Ophthalmologist.
-Develops Idiopathic Epilepsy before 4years of age-
-Develops autoimmune health problems by months of age. Confirmed by laboratory testing and/or Veterinarian letter.
-Develops a disqualifying fault as recognized by the AKC/ASCA breed standards.
The breeder will offer the purchaser the option of a replacement dog if available, or 1/4 the purchase price back upon return of
the dog or documentation of Spay/neutering. Replacement will be of the breeders’ choice of available puppies or adult dogs.
I the purchaser have read the above contract and understand the conditions of sale, Health warranties and overall health care
and training of this Dog.
The breeder is not responsible for loss, theft or damage to property or personal injury caused by said dog
It is further agreed between parties that in the event that the purchaser(s) DOES NOT care for His/Her Australian shepherd
according to the terms, conditions, and agreements set-forth herein, The breeder (S) are released from any and all responsibility
and/or liability whatsoever arising from this purchase agreement.
